What is a work certificate?

A work certificate is a document issued by an employer or company to verify that an employee has worked in a specified position and period mentioned in the certificate. A work certificate typically includes the following information.

  • Employee's Name: Specifies the full name of the employee who has worked.
  • Job Title: Specifies the position the employee has held.
  • Duration of Employment: Specifies the start date and end date of the employee's tenure.
  • Duties and Responsibilities: Describes the roles and tasks the employee performed during their employment.
  • Employer Information: The name of the company or organization, along with contact details.
  • Signature of Authorized Person: The handwritten signature of the authorized person in the company, such as the manager or department head.
  • The work certificate will not contain any language that disparages the employee under any circumstances (even if there were misconduct in the workplace, the employer cannot state reasons for termination in the work certificate).

What are the benefits of a work certificate?

1.Confirmation of Work Experience: It serves as evidence verifying that the individual has worked in the specified position and for the stated duration, helping new employers feel confident about the applicant's experience and capabilities.

2.Applying for a New Job: It enhances credibility during job applications, enabling prospective employers to more easily assess the suitability of the applicant.

3.Visa Applications: It is used as supporting documentation for work visas or other types of visas that require proof of past employment.

4.Loan Applications or Mortgage Applications: Banks or financial institutions often require proof confirming that the applicant has a stable income and employment history.

5.For Further Education: For individuals seeking higher education, sometimes educational institutions require proof of work experience to consider admission.

6.Professional Credentialing: It serves as evidence to confirm professional abilities for various professions such as engineers, doctors, or lawyers.

A work certificate can be requested retroactively according to the law, but it is advisable to request it promptly. If the employee's information is no longer available in the former company's system, obtaining the certificate might become difficult. Companies are legally obligated under the Civil and Commercial Code, Section 585, to issue work certificates to employees in all circumstances. Failure to do so could lead employees to seek recourse through the labor court.

Compilation of Commercial and Civil Laws Related to Work Certificates.

Section 585: When the employment relationship terminates, employees have the right to receive a certificate indicating the duration of their employment and the nature of their work. If an employer fails to comply, employees can file a complaint with the labor inspector to issue an order for the employer to comply, as stipulated in Section 14 of the Labor Protection Act B.E. 2541, which mandates that employers must treat employees fairly and fulfill their rights and duties as specified by commercial and civil laws, unless otherwise provided by royal decree.

A work certificate is a crucial document for applying for new jobs as it helps confirm the experience and capabilities of the employee to prospective employers. Additionally, it is used for various purposes such as visa applications, further education enrollment, or financial transactions in some cases.
