According to the Labor Protection Act B.E. 2541 (amended B.E. 2562), in Section 23, it is stipulated that the employer must set the regular working hours per day to be no more than 8 hours, excluding break time. The employer must provide employees with a break of not less than 1 hour after working for at least 5 hours. This break can be at any time as agreed upon by the employer and the employee. Many companies commonly set the working hours at 9 hours, which includes the 1-hour break

 

Wages for Night Shift Workers: The determination of wages for employees who work during the night, starting in the evening and ending in the early morning, such as from 10:00 PM to 6:00 AM, can be categorized as follows:

  1. Basic Wage: Night shift employees will receive wages at the regular rate agreed upon with the employer. These wages are the same as those received during regular working hours (8 hours per day).
  2. Night Shift Allowance: If an employee works beyond the regular working hours (8 hours per day), they are entitled to receive overtime pay. According to Thai labor law, this must be paid at a rate of 1.5 times the regular wage.
  3. Night Shift Allowance : For employees working the night shift (between 10:00 PM and 6:00 AM), the employer may provide additional night shift pay on top of the regular wages. The rate for night shift pay depends on the company's policy or the agreement between the employer and the employee.
  4. Holiday Pay : If an employee has to work on legally designated holidays, such as weekly days off or public holidays, they must receive wages at a rate of 2 times the regular wage, or 3 times the regular wage if working overtime on these holidays.

 

However, the management of wages for night shift employees depends on the regulations and policies of each company. Therefore, employees should review the terms in their employment contract and the company's policies to ensure they receive fair wages in compliance with labor laws.
