Business owners or employers who fail to register their employees for social security are in violation of the Social Security Act B.E. 2533. Employers are obligated to register eligible employees in the social security system and make the required contributions. Failure to do so not only harms the employees but also subjects the employer to legal penalties.

 

The Social Security Office has stipulated that 'Employers with at least one employee must register as an employer and also register their employees as insured persons with the Social Security Office. This registration must be completed within 30 days from the date of employment. When hiring new employees, the employer must notify and register them within the same 30-day period. When an employee resigns, the employer is also responsible for removing the employee's name from the social security system, specifying the reason for the termination. This must be reported within 15 days of the following month, along with the deduction and submission of social security contributions.'

 

In cases where employers fail to pay social security contributions for their employees, they are in violation of the Social Security Act B.E. 2533 and may face a penalty of imprisonment for up to 6 months, a fine of up to 20,000 baht, or both.

 

In cases where employers pay social security contributions late, after the 15th of the following month from the payroll date, they must pay an additional 2% per month from the due date. For example, for March wages, the employer must deduct the contribution and submit it to the Social Security Office by April 15th. However, if the employer submits the contribution on April 30th, they will need to pay an additional 2% for a period of 15 days (half a month).

 

In cases where employers fail to pay the full amount of social security contributions, they must pay an additional 2% per month on the shortfall in contributions.
